Felch v. Findlay College, No. 640, 

Court of Appeals of The Third Appellate Judicial District of Ohio, Hancock County, 

June 28, 1963. 

 

원고 William E. Felch는  피고 사립 비영리 단체a private non-profit corporation인 Findlay College의 교원이었다. 1958년 10월, 대학 측은 정년 규정tenure regulations을 포함한 규칙을 발하였다. 1959년 8월, Felch는 그 규칙에 따라 정년직이 되었다는 통지를 받았다. 그 규칙 제5문은 해고 규정을 정하고 있는데, 그 내용은 다음과 같다. 

“조사를 완료하고, 단과대 학장, 의장 및 학과장과 협의한 후에 운영위원회의 승인을 얻어서, 총장은 재단 또는 이사회에 해고를 권고할 수 있다.”

1961년 7월 20일, 이와 같은 해고 절차를 거치지 않은 상태에서 해고통지를 수인할 것인지 아니면 사직할 것인지를 1시간 내에 결정 하라고 통보했다. Felch는 자신에게 부과된 혐의를 부인했고, 해고통지를 선택하면서, 해고의 정당성에 관해 다툴 것이라고 재단 이사회측에 알렸다. 그러나 재단 이사회는 총장의 결정을 승인하였다. 그 후에 Felch는 자신에 대한 해고 무효를 구하는 소송을 제기하였다.
